The US DoJ Sues Alabama for Purging Non-Citizens from Voters List

POLIBIZ - Biden-Harris’ Administration’s Justice Department (DoJ) announced on 27th Sept  that it has filed a lawsuit against the State of Alabama and the Alabama Secretary of State to challenge a systematic State program aimed at removing voters from its election rolls too close to the Nov. 5 general election, in violation of the National Voter Registration Act of 1993 (NVRA).

Biden-Harris’ Administration’s Justice Department (DoJ) announced on 27th Sept  that it has filed a lawsuit against the State of Alabama and the Alabama Secretary of State to challenge a systematic State program aimed at removing voters from its election rolls too close to the Nov. 5 general election, in violation of the National Voter Registration Act of 1993 (NVRA).

After being sworn into office on January 16, 2023, Alabama Secretary of State Wes Allen immediately initiated strategic efforts to ensure that Alabama has the cleanest and most accurate voter file in the country. He has identified 3,251 Alabama voters as non-citizens based on the Noncitizen Identification Numbers by the Department of Homeland Security.  “I have been clear that I will not tolerate the participation of noncitizens in our elections,” Allen said

Allen planned to intensify the vote purging of non-citizens but encountered the lack of assist from Federal Government in providing a list of noncitizens currently residing in Alabama.

Allen also applies an update scheme so that the individuals who were non-citizens but now has obtained citizenship can update their status and be eligible to vote.

Allen said. “I am hopeful that in the near future the federal government will change course and be helpful to states as we work to protect our elections.”

In his latest attempt to further purge the voter roll kicked off on Aug 13th, Allen  has faced challenge and lawsuit from the DoJ, who quoted the Quiet Period Provision, which requiring  states to complete systematic programs aimed at removing the names of ineligible voters from voter registration lists by no later than 90 days before federal elections. This was 84 days before the Nov. 5 general election, DoJ reasoned.

Republicans and Democrats have conflicting approaches on the transparency of voters roll. Republicans continuously have taken actions and policies to enhance the transparency such as continuous update of the list and removal of eligible voters, requirement of proof of citizenship to register to vote in federal elections. However, the efforts of Republicans have been strongly opposed and neutralized by Democrats and the White House.
