Did Kamala Harris violate Hatch Act 1939 for abusing the government platform to attack Trump?

POLIBIZ –  On 23rd Oct 2024, Kamala Harris organized a “press conference” at the White House and made vicious political attacks on Republican Presidential Candidate Donald J. Trump as “fascist”, “dictator”. Representative Cory Mills (R, Florida) sent a letter to the US Department of Justice questioning whether Kamala’s action “appears to be a direct use of official authority to affect the upcoming election”.

Incumbent US Vice President uses the White House podium to attack her her political opponent - Republican Presidential Candidate Donald Trump.




In her 3-minute speech at the White House, Vice President officially declared “Donald Trump vowed to be a dictator on day one. He vowed to use the military to carry out personal and political vendettas. His former chief of staff said he wanted generals like Hitler’s. So the bottom line is this: rump wants unchecked power. In 13 days, the American people will decide what they want.

Kamala often describes her political opponent Donald Trump as “a dictator” or “a threat to democracy” in her various rallies, talk-shows, podcasts, interviews... However, this is the first time the incumbent Vice President took the White House platform to officially declare this.

When a top government official declares something at the White House, it’s understood as a governmental policy and standpoint to the public and a message to foreign leaders as well.

Cory Mills wrote “While the Hatch Act, which prohibits using official resources to support partisan political campaigns, does not apply to the President and Vice President in civil provisions, it does not exempt them from criminal provisions. In Federal law it is a crime for any federal officer or employee to "use his official authority for the purpose of interfering with, or affecting, the nomination or the election of any candidate for the office of President, Vice President, Presidential elector, Member of the Senate, Member of the House of Representatives."

It may be not a serious matter when Kamala quoted something she heard from former Chief of Staff  John Kelly, but when she declared “Trump wants unchecked power. In 13 days, the American people will decide what they want”, it’s obviously an action of “use her official authority for the purpose of interfering with the election of any candidate for the office of President” - or an abuse of power.

The Representative’s letter was addressed to Attorney General of Department of Justice and it’s forecasted that no immediate action would be taken before the Election Day. However, it may help raise the awareness about the fine line which Kamala’s campaign should not recklessly cross when turning to desperate measures. 

In Sept 2024, the House Oversight Committee opened investigation into "abuse of power” by Biden-Harris Administration related to an ammunition visit of Ukrainian President Zelenskyy.  If it is concluded that the tour was clearly a partisan campaign event of Democrats, serious questions would be raised about the use of taxpayer’s fund for the visit as well as the foreign interference in the US presidential election. However, there's been no update about the progress of this investigation so far.
